Terms of Service

These terms set out the general framework for using the Nexa Academy website and arranging tutoring services with us.

These are general terms. Before paid tutoring begins, we may provide booking details or a service agreement containing specific prices, lesson arrangements, cancellation periods, and other practical terms. If a specific written term conflicts with this page, the more specific agreed term will apply to that service.

1. About these terms

These Terms of Service govern access to the Nexa Academy website and the tutoring or educational support we agree to provide. By using the website, submitting an enquiry, or booking a service, you agree to these terms to the extent applicable.

References to “we”, “us”, and “our” mean Nexa Academy. “You” means the person using the website or entering the agreement. Where services are for a student under 18, “you” normally includes the parent or guardian responsible for the booking and payment.

2. Eligibility and authority

You must provide accurate information and have authority to arrange the service. A person booking for a child confirms that they are the child's parent or guardian, or otherwise have permission to make the arrangement.

You should tell us about information reasonably relevant to safe and appropriate service delivery, including learning needs, accessibility requirements, or safeguarding concerns. We will consider whether we can meet the requested needs but cannot guarantee that every request can be accommodated.

3. Tutoring services

The subject, level, tutor, lesson format, frequency, and intended start date will be agreed before services begin. We may recommend a plan, but the final arrangement depends on availability and acceptance of the applicable fees and terms.

We aim to match students thoughtfully and deliver tutoring with reasonable skill and care. Tutors may adapt lesson content, pace, and resources in response to the student's progress and priorities.

Tutor availability

A particular tutor, timeslot, or schedule is not guaranteed until confirmed. If a tutor becomes unavailable, we may offer an alternative tutor, time, lesson credit, rescheduled session, or refund for an affected prepaid lesson, as appropriate.

4. Booking, fees, and payment

Fees, billing frequency, payment method, and due dates will be communicated before booking. Unless otherwise agreed, payment must be received by the stated due date for lessons to remain confirmed.

  • You are responsible for checking invoices and raising genuine queries promptly.
  • We may pause future lessons where an amount remains overdue after reasonable notice.
  • Any package expiry, credit, discount, or promotional condition will be stated when offered.
  • You are responsible for costs charged by your own bank, internet provider, or equipment provider.

We may change future pricing by giving reasonable notice. A change will not retrospectively increase the fee for a lesson already paid for and confirmed.

Recurring bookings and saved payment methods

Where you choose weekly pay-per-lesson billing, you authorise us and our payment provider to store the selected payment method and charge each scheduled occurrence automatically. Where you choose a four-week plan, four weekly lessons are billed every 28 days until renewal is cancelled. The checkout summary and confirmation email will identify the amount, frequency, and method for cancelling future renewal.

Payment credentials are handled by our payment provider and are not stored as full card details by Nexa Academy. A failed recurring payment may cause the affected lesson or series to be paused or released after the notified recovery period.

5. Cancellations, lateness, and rescheduling

The notice period and consequences for cancellation or rescheduling will be confirmed as part of the booking arrangement. Where no more specific written term has been agreed, contact us as early as reasonably possible so we can assess whether a lesson can be moved.

Late arrival by the student may reduce the available teaching time, and the lesson may still end at the scheduled time. If a tutor is late, we will seek to provide the full booked duration or arrange a fair alternative.

A lesson affected by illness, emergency, technical failure, or other exceptional circumstances will be handled reasonably in light of the cause, notice provided, and whether useful teaching could take place.

Unless a more specific written arrangement applies, a customer cancelling more than 24 hours before a one-off or pay-per-lesson booking may choose an eligible refund or same-service reschedule. A timely cancellation from a four-week plan normally creates a lesson credit valid for 30 days. Cancellations inside 24 hours are normally chargeable. If a tutor cancels, we will offer an appropriate refund, credit, or reschedule.

6. Conduct and safeguarding

Students, parents, guardians, tutors, and staff must communicate respectfully and must not engage in harassment, discrimination, intimidation, abuse, dishonesty, or unlawful conduct.

Contact with tutors should take place through agreed and appropriate channels. A parent or guardian should remain responsible for the student's welfare and supervision outside the tutor's teaching role. Tutoring does not replace childcare, school supervision, clinical support, or emergency services.

We may take proportionate action where a safeguarding, welfare, or conduct concern arises, including pausing contact, involving a parent or guardian, keeping appropriate records, or contacting a relevant authority where necessary.

7. Online lessons and technology

You are responsible for a suitable device, stable internet connection, working audio, and a quiet, safe learning environment. Students should join at the agreed time using the link or platform provided.

We are not responsible for disruption caused solely by the student's equipment, connection, or environment. If a platform or tutor-side technical problem materially prevents the lesson, we will discuss a reasonable remedy such as rescheduling or lesson credit.

Lessons must not be recorded, photographed, or shared by either party without prior agreement and any consent required by law.

8. Learning materials and intellectual property

Unless stated otherwise, lesson resources and materials supplied by Nexa Academy or a tutor are provided for the student's personal, non-commercial learning. You may not sell, publish, upload, reproduce at scale, or distribute those materials without written permission.

Third-party textbooks, exam papers, platforms, and resources remain subject to their owners' rights and terms. Access supplied for one student must not be shared beyond the permitted user.

The Nexa Academy name, branding, website design, and original website content may not be used in a way that suggests endorsement, affiliation, or ownership without permission.

9. Academic outcomes

We support students to improve understanding, skills, confidence, and preparation, but we cannot guarantee a particular grade, score, admission decision, offer, ranking, or other outcome.

Results depend on many factors outside our control, including attendance, effort, independent practice, prior knowledge, health, school provision, assessment conditions, and decisions made by examination bodies or educational institutions.

Students must submit their own work and follow applicable academic integrity rules. Tutors may guide, explain, review, and give feedback, but will not complete assessed work dishonestly on a student's behalf.

10. Responsibility and liability

Nothing in these terms excludes or limits liability where doing so would be unlawful, including liability for fraud or for death or personal injury caused by negligence.

Subject to that, we are not responsible for losses that were not reasonably foreseeable when the service was agreed, losses caused by information or circumstances you did not disclose, or indirect business losses arising from consumer use of the service.

Our responsibility for a service concern will be assessed in light of the applicable law, the specific agreement, the fees paid, the nature of the problem, and the steps reasonably available to reduce or remedy the loss.

11. Pausing or ending services

You may stop future tutoring in accordance with the notice, payment, cancellation, and package terms agreed for your booking. Please notify us in writing so the end date and any remaining confirmed lessons can be recorded clearly.

We may pause or end services on reasonable notice, or sooner where there is serious misconduct, a safeguarding concern, repeated non-payment, persistent non-attendance, misuse of materials, or a breakdown in the working relationship that cannot reasonably be resolved.

Ending tutoring does not remove rights or obligations that have already arisen, including payment due for properly provided or chargeable lessons.

12. Website use

You may use the website for lawful personal purposes. You must not attempt to disrupt, damage, probe, reverse engineer, overload, or gain unauthorised access to the site or connected systems, nor use the site to distribute malicious or unlawful content.

We aim to keep website information useful and current but do not promise that every page will always be complete, error-free, or available. Programme information is general and does not form a confirmed booking until specific terms have been agreed.

Links to external websites are provided for convenience and do not mean we control or endorse their content, availability, or practices.

13. General terms

Privacy

We handle personal information as described in our Privacy Policy and any additional information provided when services are arranged.

Changes to these terms

We may update these terms for future use of the website or services. The latest version will appear on this page with an updated effective date. Changes to an existing tutoring arrangement will be communicated where they materially affect the agreed service.

Severability and waiver

If one provision is found unenforceable, the remaining provisions will continue to apply. A delay in enforcing a right does not automatically waive that right.

Governing law

The governing law and courts applicable to a tutoring agreement may depend on where the contracting parties are based and any specific written terms agreed. Nothing in these terms removes mandatory consumer rights that apply to you.
